Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the ShootHive website at www.shoothive.net and the ShootHive application (together, the “Service”). The Service is operated by Viacheslav Yakobchuk (“ShootHive”, “we”, “us”). You can reach us at slava.yakobchuk@shoothive.net.

By creating an account, requesting access, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. If you accept these Terms on behalf of a studio, company, or other legal entity, you represent that you have authority to bind that entity, and “you” refers to that entity.

3. Availability and changes

The Service is provided on an “as is” and “as available” basis and may experience downtime. We continue to develop ShootHive actively and may modify, suspend, or discontinue any part of the Service at our reasonable discretion, giving notice of material changes where practicable.

4. Your account

You are responsible for keeping your credentials confidential and for any activity that occurs in your account. You agree to notify us at slava.yakobchuk@shoothive.net immediately if you suspect unauthorized access.

5. Your content

You retain all rights to content you create in or upload to ShootHive — projects, shoots, contacts, releases, budgets, files you import, and any other material (your “Content”). You grant ShootHive a limited, non-exclusive, worldwide, royalty-free licence to host, transmit, display, cache, and process your Content solely as necessary to provide the Service to you. This licence ends when you delete the relevant Content or close your account, except for backups retained for the period stated in the Privacy Policy.

6. Third-party services (Google and others)

ShootHive integrates with third-party services such as Google (Google Sign-In and Google Drive). When you connect such a service, you authorize ShootHive to access it on your behalf within the OAuth scopes you approve. ShootHive’s use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements (see Section 5 of the Privacy Policy).

Your use of any third-party service through ShootHive is additionally governed by that service’s own terms (for example, the Google Terms of Service). ShootHive is not responsible for third-party services and is not affiliated with Google or any other third-party provider.

7. Acceptable use

You agree not to:

  • violate any applicable law or third-party right;
  • upload, store, or transmit malware, viruses, or harmful code;
  • attempt to gain unauthorized access to the Service or other users’ data, or otherwise interfere with the integrity or security of the Service;
  • reverse engineer, decompile, or attempt to derive the source code of the Service, except to the extent that applicable law expressly permits despite this restriction;
  • process personal data of third parties without a valid legal basis;
  • use the Service to create competing products, scrape data, or generate inputs for training generalized AI/ML models.

8. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access for breach of these Terms, or otherwise at our reasonable discretion with reasonable notice where practicable. On termination, you may export your workspace data for a reasonable period as described in the Privacy Policy.

9. Disclaimer

The Service is provided “as is” and “as available”, without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the maximum extent permitted by law, in no event will ShootHive be liable for any indirect, incidental, special, consequential, or exemplary damages, or for loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service. ShootHive’s aggregate liability arising out of or related to the Service is limited to the greater of (a) the fees you paid us in the twelve (12) months before the event giving rise to liability and (b) USD 50.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

11. Indemnity

You agree to indemnify and hold ShootHive harmless from any third-party claim arising out of your Content, your use of the Service in violation of these Terms, or your violation of any law or third-party right, except to the extent caused by ShootHive.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated to active users by email and reflected by an updated “Last updated” date at the top of this page. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws applicable to your principal place of residence, without regard to conflict-of-law rules. The parties agree to attempt in good faith to resolve any dispute informally by contacting slava.yakobchuk@shoothive.net before initiating any formal proceedings. Mandatory consumer protections in your jurisdiction continue to apply.

14. Billing, cancellation and refunds

Paid plans are billed per operator. Payments are processed by Paddle.com, which acts as the Merchant of Record for your purchase; applicable taxes are calculated and collected by Paddle. You can cancel at any time from your billing settings — your paid plan stays active until the end of the current billing period, after which the organization returns to the free plan. We do not delete your data on cancellation.

Changing your billing period. You can switch between monthly and annual billing at any time. The change applies immediately and the amount is prorated: when you switch to annual, the unused part of the current month is credited and the annual amount is charged; when you switch from annual back to monthly, the unused portion is credited to your Paddle account and applied to future charges rather than refunded to your card.

Refunds. ShootHive offers a free plan with the full product, so you can evaluate the Service before paying. Because of this, payments are generally non-refundable, and cancelling stops future charges rather than refunding the current period. If you were charged in error, experienced a technical problem that prevented you from using a paid plan, or believe a refund is otherwise warranted, contact us within 14 days of the charge via the contact page and we will review your case individually. Where we approve a refund, it is returned by Paddle to your original payment method.
